Rental Terms & Conditions

1. Services Covered

This Agreement covers:

• Roll-off dumpster (bin) rentals
• Tote rentals
• Junk removal services

2. Booking, Payment & Credit Card Authorization

Once your booking is approved, you will receive an invoice. Payment must be received within 24 hours of approval to secure your rental or service.

Your credit card will be kept on file for the duration of the rental and for a reasonable period afterward. You authorize Busy Bins to charge the card on file for the rental fees, any applicable taxes, additional days, excess weight charges, damage fees, lost/unreturned equipment fees, refrigerant item fees, and any other amounts owed under this Agreement.

3. Rental Periods

• Totes: Standard rental period is two (2) weeks unless otherwise agreed in writing.
• Roll-off Dumpsters: Rental period is as stated on your invoice/confirmation (commonly 2 or 14 days). Early pickup or extensions must be requested in advance and may incur additional fees.
• Extensions are not guaranteed and are subject to equipment availability and additional charges.

4. Customer Responsibilities

Customer agrees to:

• Provide accurate delivery/pickup location and ensure safe, legal access for trucks and equipment.
• Place equipment only on the approved location. Customer is solely responsible for any permits required by local authorities.
• Not overload dumpsters or totes beyond marked weight or fill lines. Overfilled or overweight containers may result in additional fees or refusal of pickup.
• Only place permitted materials in dumpsters and totes. Prohibited items typically include (but are not limited to) hazardous waste, chemicals, asbestos, tires, batteries, medical waste, and liquids unless specifically approved.
• Keep the area around the dumpster or totes clear and safe.

5. Liability Waiver & Assumption of Risk

You assume all risk associated with the use of the equipment and services. You agree to use the dumpsters and totes in a careful and proper manner.

6. Weight, Special Items & Additional Fees

Excess Weight – Roll-off Dumpsters

• The first (1st) ton is included at no additional charge.
• Any weight beyond the first ton will be charged at $49.25 per ton. Your credit card on file will be charged for all excess tonnage after the dumpster is weighed.

Items Containing Refrigerant

• Refrigerators, air conditioners, freezers, or any other items containing refrigerant will incur an additional fee of $50.00 per unit.

Tote Fees

Dumpster Damage

Any damage to the dumpster (including but not limited to cuts, burns, structural damage, contamination, or excessive wear beyond normal use) will be assessed after pickup and billed to the Customer at the cost of repair or replacement, plus any related fees.

Additional fees may also apply for: overfilled containers, prohibited materials, waiting time, difficult access, after-hours service, or special handling.

7. Junk Removal Services

Junk removal is performed on a quoted or estimated basis. Final pricing may adjust based on actual volume, weight, or materials encountered (including refrigerant items). Customer is responsible for ensuring items are accessible and ready for removal. Busy Bins is not responsible for damage to items left behind or to surrounding property during the removal process.

8. Cancellation Policy

• Cancellations made within seven (7) days of the scheduled booking/delivery date are non-refundable.
• Cancellations made several days or more before the scheduled booking/delivery date are 100% refundable (minus any non-refundable processing fees, if applicable).
• Same-day cancellations or failures to provide access may result in full charges.

9. Indemnification

Customer agrees to indemnify, defend, and hold harmless Busy Bins, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising out of Customer’s use of the equipment or services, Customer’s negligence, or Customer’s breach of this Agreement.

10. General Provisions

• This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions.
• If any provision is found unenforceable, the remaining provisions shall remain in full force.
• This Agreement shall be governed by the laws of the State of South Dakota.
• Failure to enforce any provision does not constitute a waiver of that provision.
